Purpose of Collection: When you grant Pacaya access to your Contact List, we use this information solely to help you connect with friends who are also using Pacaya.

Limited Use: The data collected is strictly for connection purposes within the app and will never be shared with third parties without your explicit consent.

1.2 Prominent Disclosure and Consent

Clear Disclosure: Before accessing your Contact List, Pacaya provides a clear and detailed Prominent Disclosure explaining:

  • What data is collected

  • Why it is collected

  • How it will be used

Explicit Consent: You must explicitly consent to data collection before any access occurs. If you deny access, Pacaya will respect your choice and will not collect your Contact List data.

 

2. Data Transmission and Security

2.1 Secure Data Transmission

All user data, including Contact List information, is transmitted securely using modern cryptographic standards over HTTPS. Pacaya does not transmit any data over insecure connections.

2.2 Encryption

Data from your Contact List is encrypted before transmission to ensure your information remains private and secure.

3.1 Opt-Out of Data Collection

You can revoke Pacaya’s access to your Contact List at any time by adjusting your device’s permissions. Once access is revoked, no additional data will be collected.

3.2 Request for Data Deletion

4. General Terms of Use

4.1 Content Ownership and Usage

By posting on Pacaya, you confirm that you own the content or have explicit permission to share it.

  • Once content is uploaded, you grant Pacaya a perpetual, irrevocable, royalty-free license to use, modify, distribute, and promote the content for advertising, promotional, or other purposes as Pacaya deems fit.

  • All posted content becomes the property of Pacaya International Inc. upon submission.

4.2 Prohibited Activities

Users may not:

  • Post illegal, defamatory, or inappropriate content.

  • Harass, abuse, or harm other users.

  • Use the platform to engage in unauthorized activities.

4.3 Copyright and Trademark

Pacaya’s trademarks (™) and intellectual property are protected under U.S. and international laws. Unauthorized use of Pacaya’s intellectual property is strictly prohibited.

 

5. Updates to Terms and Conditions

Pacaya reserves the right to update these Terms and Conditions as necessary to reflect changes in our practices, legal requirements, or new features. Users will be notified of updates through the app. Continued use of Pacaya after updates constitutes acceptance of the revised Terms and Conditions.

To ensure user safety, Pacaya offers an Emergency Button feature:

  • 📍 Sends your location to pre-selected trusted contacts.

  • 📱 Sends an alert message in case of emergencies.

  • 🔒 Quick Access: Easily accessible through the app’s safety menu.

6.2 Privacy Controls

  • Ghost Mode: Browse Pacaya without revealing your location.

  • Profile Visibility: Adjust who can see your profile and activities.

  • Data Encryption: All sensitive data is securely encrypted.

 

7. International Compliance

7.1 Data Protection Laws

Pacaya adheres to global privacy standards, including:

  • GDPR (European Union)

  • CCPA and CPRA (California)

  • French Data Protection Law

  • Children’s Online Privacy Protection Act (COPPA) (United States)

7.2 User Rights

  • Access, modify, or delete your data at any time.

  • Manage data collection permissions in your device settings.

 

8. Arbitration and Dispute Resolution

  • Mandatory Arbitration: All disputes will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA).

  • No Class Actions: Users agree to resolve disputes individually and waive the right to participate in class-action lawsuits.
