Pacaya International Inc. (“Pacaya,” “we,” “us,” or “our”) respects the rights of creators and intellectual property owners. This Copyright Policy explains how we handle copyright-related issues on Pacaya App (“the Service”) in accordance with the Digital Millennium Copyright Act (DMCA), U.S. copyright laws, and international copyright standards.

2. User Responsibility

When you upload or share content (photos, videos, text, or location-based activities) on Pacaya, you represent and warrant that you own or control the rights to the content, or that you have obtained all necessary permissions, licenses, or authorizations to use and share it on Pacaya App.
You are solely responsible for any content you upload. Using copyrighted material without authorization may result in content removal, account suspension, or legal consequences.

3. Reporting Copyright Infringement

If you believe that your copyrighted work has been used on Pacaya App without authorization, you may submit a DMCA Takedown Notice following our DMCA Policy. The notice must include:

  1. Your contact details (name, address, email)

  2. Identification of the copyrighted work

  3. URL or details of the infringing material

  4. A statement under penalty of perjury that you own or represent the copyright owner

We will promptly investigate and, if appropriate, remove or restrict access to the infringing material.

4. Counter-Notice Procedure

If you believe content was removed in error, you may submit a Counter-Notice as outlined in the DMCA Policy.
Pacaya may restore the content after verification unless legal proceedings are initiated by the copyright owner.

5. Repeat Infringer Policy

In compliance with Section 512(i) of the DMCA, Pacaya maintains a repeat infringer policy.
Accounts that receive multiple valid copyright complaints may be suspended or permanently terminated. Repeat violators may also lose posting privileges, even if subsequent content is unrelated.
We track infringement reports to ensure consistent enforcement.

6. Removal of Content

Pacaya reserves the right to remove any content at any time without notice if it violates copyright law or this policy. We may disable access to infringing materials and notify the uploader, and we may cooperate with copyright owners, law enforcement, or legal authorities where necessary.

7. Fair Use and Open Source Content

Users may share or remix content that falls under fair use, Creative Commons, or open-source licenses — provided that attribution requirements are met and license conditions are followed.
Pacaya encourages the use of properly licensed content to foster creativity and collaboration.

8. External Integrations

Pacaya uses third-party data and integrations, including Google Maps Platform, Google Places, and TikTok Ads API. These platforms maintain their own copyright and data policies.
When you interact with content powered by these services, you agree to comply with their terms.
