Pacaya Terms and Conditions for Event Organizers

Welcome to Pacaya!

These Terms and Conditions (“Terms”) govern the relationship between Pacaya Inc. (“Pacaya”), a company headquartered in Delaware, and local businesses (“Business,” “You,” or “Your”) that use our platform to promote their services, engage with local communities, and advertise their offerings. By creating a business account on Pacaya, you agree to comply with these Terms.

1. Acceptance of Terms 📜

By creating and using a business profile on Pacaya, you:

• Confirm that you are authorized to represent the business.
• Agree to comply with all applicable laws and regulations.
• Accept these Terms in full and understand that Pacaya reserves the right to update them periodically.

If you do not agree to these Terms, please do not use the platform for business purposes.

2. Business Account Registration 🏢

To create a business account, you must:

• Provide accurate and complete business details (name, location, contact information).
• Select an appropriate business category.
• Keep your profile information up to date.

Pacaya reserves the right to approve, reject, or suspend any business account if provided information is inaccurate, misleading, or violates our policies.

3. Free Business Listings 🎉

Businesses can:

• List themselves on the Explore Page at no cost.
• Post updates and promotions in the Feed for free.
• Engage with local customers and respond to inquiries.

Pacaya Branding: Free business listings will include “Powered by Pacaya.” Businesses can remove branding by upgrading to a paid plan.

4. Paid Advertising & Boosted Promotions 💰

Businesses may purchase advertising to enhance visibility.

Advertising Options:

• Appear in priority positions on the Feed, Explore Page, and event pages.
• Budget-friendly daily options starting from $1/day.
• Geo-targeting and audience segmentation for personalized promotions.

Payment Terms:

• Payments are securely processed via approved payment gateways.
• Advertising fees are non-refundable unless due to verified technical errors.
• Businesses can cancel ads with 24 hours’ notice; however, refunds are not provided for used services.

Pacaya reserves the right to remove advertisements that violate content guidelines or ethical standards.

5. Content and Conduct Guidelines 🚫

Businesses agree to:

• Post truthful and lawful content relevant to their services.
• Avoid misleading claims or deceptive practices.
• Refrain from posting offensive, discriminatory, or illegal content.

Prohibited Content Includes:

• Inappropriate or vulgar language.
• Promotion of illegal products or services.
• Spam, fraudulent schemes, or misleading advertisements.

Pacaya may remove content that violates these guidelines without notice and suspend accounts for repeated violations.

6. Intellectual Property Rights ⚖️

• Businesses retain ownership of their brand materials, including logos, images, and promotional content.
• By using Pacaya, businesses grant Pacaya a non-exclusive, worldwide license to display and promote their content on the platform.
• Pacaya trademarks, branding, and intellectual property may not be used without prior written consent.

7. Data Collection and Privacy 🔐

By using Pacaya, you acknowledge and agree that:

• Pacaya collects business data such as profile information, analytics, and engagement metrics.
• Pacaya may use this data to improve platform functionality, personalize recommendations, and generate insights.
• Businesses must comply with applicable data protection laws when handling customer information collected via Pacaya.

8. Customer Interactions & Reviews ⭐

• Customers can leave reviews on business pages.
• Businesses must not engage in fake reviews or review manipulation.
• Pacaya does not mediate disputes between businesses and customers but may remove inappropriate reviews.

9. Fraud Prevention & Security 🛡️

Businesses are responsible for ensuring the integrity of their account by:

• Providing accurate and truthful business information.
• Using legitimate payment methods for advertising.
• Refraining from exploiting vulnerabilities in the system.

Pacaya implements fraud detection measures and reserves the right to suspend accounts flagged for suspicious activity.

10. Account Suspension & Termination ⚠️

Pacaya may suspend or terminate business accounts under the following conditions:

• Violation of these Terms and Conditions.
• Involvement in fraudulent or unethical activities.
• Repeated complaints or reports from customers.

Businesses may request account reinstatement by contacting support@pacaya.com

11. Refunds and Cancellations 🔄

Paid promotions may be canceled with 24 hours’ notice, with refunds only applicable to unspent funds.

No refunds will be provided for partially completed promotions.

Refund requests related to technical issues must be submitted within 14 days of the incident.

12. Limitation of Liability ⚠️

Pacaya provides its services “as-is” and does not guarantee:

• Increased sales or customer engagement.
• Uninterrupted platform access due to technical issues.
• The success or profitability of any business using the platform.

Pacaya is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform.

13. Indemnification 🤝

By using Pacaya, businesses agree to indemnify and hold Pacaya harmless from any claims, liabilities, damages, or expenses arising from:

• Misrepresentation of services.
• Violation of these Terms and Conditions.
• Legal disputes with customers or third parties.

14. Amendments to Terms ✍️

Pacaya reserves the right to update or modify these Terms at any time. Businesses will be notified of significant changes via email or in-app notifications. Continued use of the platform after such changes constitutes acceptance of the revised Terms.

15. Governing Law ⚖️

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
