Pacaya International Inc. (“Pacaya,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of the Pacaya App (“the Service”) to do the same. This DMCA Policy describes how copyright owners can report allegedly infringing content and how users may respond.

2. How to Submit a Takedown Notice

If you believe that material available on Pacaya infringes your copyright, you must send a written notice containing all of the following elements (17 U.S.C. § 512(c)(3)):

  1. Your physical or electronic signature

  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered

  3. Identification of the material that is allegedly infringing and information sufficient to allow us to locate it (e.g., URLs or screenshots)

  4. Your contact information (name, mailing address, phone number, and email address)

  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law

  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Incomplete or invalid notices may not be processed.
Pacaya may forward your notice to the user who posted the content.

3. Our Response

After receiving a valid notice, Pacaya may remove or disable access to the allegedly infringing material and notify the user responsible for uploading it.
We may also terminate repeat offenders in accordance with our Copyright Policy and Terms of Service.

4. Counter-Notice Procedure

If you believe your content was removed by mistake or misidentification, you may send a written counter-notice that includes the following (17 U.S.C. § 512(g)):

  1. Your physical or electronic signature

  2. Identification of the material removed and the location where it appeared before removal (e.g., the URL)

  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification

  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for your district (if in the U.S.) or for the Northern District of California (if outside the U.S.), and that you will accept service of process from the complainant or their agent

Upon receiving a valid counter-notice, Pacaya may restore the content within 10–14 business days unless the complainant informs us that a court action has been filed to restrain such use.

5. Repeat Infringers

Pacaya will terminate accounts of users who repeatedly violate copyright laws or this policy.
We also reserve the right to remove any content at our sole discretion without notice.
